End User License Agreement (EULA) & Terms of Use

This End User License Agreement (“EULA”) is a legal agreement between you and Fronixsoft (“we,” “us,” or “our”) governing your use of Jupyter Notebook - JNote (the "App"). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.

1. Acknowledgement

This EULA is concluded between you and Fronixsoft only, not Apple. Fronixsoft is solely responsible for the App and its content. This agreement must comply with the Apple Media Services Terms and Conditions, which you acknowledge you have had the opportunity to review.

2. Scope of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. Maintenance and Support

Fronixsoft is responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services for the App.

4. Warranty

Fronixsoft is solely responsible for any product warranties, whether express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). To the maximum extent permitted by law, Apple will have no other warranty obligation. Any claims, losses, damages, or expenses related to the App’s failure to meet a warranty are solely our responsibility.

5. Product Claims

Fronixsoft is responsible for addressing any claims related to the App or your use of it, including but not limited to:

• Product liability claims
• Claims that the App fails to conform to legal or regulatory requirements
• Claims arising under consumer protection, privacy, or similar laws

6. Intellectual Property Rights

In the event of any third-party claim that the App or your use of it infringes intellectual property rights, Fronixsoft will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

7. Legal Compliance

By using the App, you represent and warrant that:

• You are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country.
• You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms when using the App. For example, if the App allows VoIP usage, you must not violate your wireless data service agreement.

10. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of the terms, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

11. Content and Usage

The App allows users to browse the web and repost content.

We do not store any user content on our servers; all reposted content remains on your device.

You are responsible for ensuring that you have the right to access, share, or repost any content.

You must not use the App for illegal or infringing activities.

12. Subscription and Payments

The App offers auto-renewable subscriptions.

Payment will be charged to your Apple ID at confirmation of purchase.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.

You may manage or cancel subscriptions in your App Store settings.

No refunds will be provided for unused portions of a subscription period.

13. Advertisements and Premium Version

The free version of the App may include advertisements. The premium version removes ads and may offer additional features.

14. Privacy

We do not collect or store any user content. Our Privacy Policy details how we handle your data; please review it.

15. Restrictions

You agree not to modify, distribute, or reverse-engineer the App.

You must not use the App to violate any laws or infringe upon third-party rights.

You must not circumvent any restrictions, including subscription-based limitations.

16. Termination

We reserve the right to terminate or suspend your access to the App if you violate these Terms.

17. Disclaimers

The App is provided "as is" without warranties of any kind. We are not responsible for third-party content or websites accessed via the App. We are not liable for any damages resulting from your use of the App.

18. Governing Law

These Terms shall be governed by the laws of India, without regard to conflict of law principles.

19. Changes to Terms

We may update these Terms at any time. Your continued use of the App after changes indicates your acceptance.
